However, we grant you a limited license to access and make personal use of the Site and the Content, provided that you do not modify any Content or reproduce or display the Content for any commercial purpose.

Products
We make reasonable efforts to accurately depict Products available on the Site, including by providing images and descriptions. However, we do not warrant that these depictions are accurate, complete, reliable, current, or error-free. The actual appearance, description, and specifications of Products will depend on the individual Product at the time of delivery. We reserve the right to substitute or modify Products to comply with technical requirements or address other issues.
The availability of Products may vary. We cannot confirm the price or availability of Products until you place an order. We reserve the right to discontinue Products or make changes to Product details, prices, or availability at any time without notice. All Products are subject to availability and we cannot guarantee that Products depicted or described on the Site will be available for purchase.
Pricing: The prices displayed on the Site are quoted in U.S. dollars. We make reasonable efforts to ensure that the prices stated for Products on the Site are correct. However, pricing errors may occur, in which case we may cancel or refuse to process any orders placed for that Product at the incorrect price. If we have already processed your order for a Product at an incorrect price, we will either contact you for instructions before shipping or cancel your order and notify you of the cancellation. If your credit card has already been charged for the purchase price and your order is canceled, we will issue a credit to your credit card account.

Shipping and Delivery: When you purchase Products, you will select a shipping method available for that Product. Delivery dates or times stated on the Site, during checkout, or in relation to any Product are estimates only. Actual delivery dates and times may vary due to factors outside of our control, such as severe weather or unforeseen shipping delays. We are not liable for any damages, costs, or losses associated with shipping delays or delivery failures. Title to and risk of loss for Products passes to you when we transfer possession of the Products to the carrier.
Returns: Items that were not eligible for the free returns benefit must be received within 60 days of purchase. Please contact our customer service before attempting to return or exchange items purchased from us.

Indemnity
You agree to defend, indemnify, and hold harmless Wireless Express, its officers, directors, employees, agents, vendors, and suppliers from and against any claims, actions, demands, damages, costs, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of (1) your use of the Site; (2) any User Content you create, submit, post, display, transmit, perform, distribute, store, or otherwise share on the Site; (3) your violation of these Terms; and (4) your violation of any rights of any other person or entity. We reserve the right to assume the exclusive defense and control of any matter subject to indemnity by you, in which case you agree to cooperate with our defense. You will not settle any indemnified claim without our prior written consent.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- IN NO EVENT WILL WIRELESS EXPRESS OR ITS DIRECTORS, EMPLOYEES, AGENTS, VENDORS, OR SUPPLIERS, BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SITE OR PRODUCTS, INCLUDING ANY DAMAGES FOR LOSS OF PROFITS, USE, DATA, GOODWILL, OR FOR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, THE SITE, OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- IN NO EVENT WILL OUR TOTAL CUMULATIVE DAMAGES ARISING FROM OR RELATED TO THE SITE OR PRODUCTS EXCEED THE LESSER OF $100 OR THE TOTAL AMOUNT YOU PAID WIRELESS EXPRESS IN THE PRIOR 12 MONTHS.
- THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION APPLY TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING ANY DAMAGES CAUSED BY NEGLIGENCE, BREACH OF CONTRACT, TORT, OR UNDER ANY OTHER CAUSE OF ACTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS ARE AN ESSENTIAL PART OF THESE TERMS.
Applicable Law and Disputes
These Terms and your access to and use of the Site will be governed by and construed in accordance with the laws of the state of Tennessee, without regard to conflict of law principles. Any dispute arising from or relating to the Site, the Content, or these Terms will be resolved in the state or federal courts located in Nashville, Tennessee. You hereby irrevocably consent to the exclusive jurisdiction and venue of such courts.
Termination
You may terminate these Terms at any time by closing your account, discontinuing your use of the Site, and providing notice to us. We reserve the right, without notice and in our sole discretion, to terminate your right to access or use the Site, at any time and for any or no reason, including for a violation of these Terms. Upon any such termination, you must immediately cease accessing or using the Site and must destroy all materials downloaded from the Site. Termination will not affect any pending purchases submitted or accepted prior to termination, unless we are legally prohibited from completing the purchase.
